1. Acceptance of Terms

a. By purchasing and accessing the Lifetime Bundle of customizable real estate templates ("Product") from Pinkpops Design (“Pinkpops”), you ("Buyer") agree to these Terms and Conditions.

2. Product Description and Usage

a. The Product consists of digital templates designed in Canva, which can only be edited using Canva.

b. The Buyer is solely responsible for editing the templates. Pinkpops does not provide customization or editing services.

c. The templates are designed using free Canva elements, images, and fonts, and they can be edited using a free Canva account. Pinkpops shall not be held liable for any changes Canva may make to its platform, including the availability of said elements, images, or fonts.

d. In the event that Canva ceases to operate, Pinkpops shall not be liable for refunds. However, Pinkpops will make reasonable efforts to identify and provide an alternative editing platform, subject to availability and feasibility at the time.

3. Access and Updates

a. Buyer will receive instant access to the digital templates upon purchase and may edit and use them an unlimited number of times.

b. Pinkpops will provide new templates on a monthly basis for as long as it continues to operate unless stated otherwise.

c. Pinkpops will make reasonable efforts to ensure that all template links remain functional and updated within the portal or other applicable sharing platforms.

d. In the event Pinkpops discontinues its services, Buyer will retain access to previously provided Canva template links, unless otherwise stated.

4. Payment and Refund Policy

a. Due to the digital nature of the Product, all sales are final and non-refundable.

b. By purchasing the Product, Buyer acknowledges and agrees to the Pinkpops refund policy and these Terms and Conditions.

5. Modifications and Company Discretion

a. Pinkpops reserves the right to modify, update, or discontinue any aspect of the Product at its sole discretion.

6. Communication

a. Pinkpops will communicate important updates, news, and announcements to Buyer via email newsletters.

b. Buyer is responsible for checking their email and reviewing said communications.

8. Limitation of Liability

a. Pinkpops shall not be held liable for any loss, damage, or inconvenience resulting from the use of the Product, including but not limited to, changes in Canva's platform, third-party restrictions, or service disruptions.

b. Pinkpops does not guarantee specific outcomes from the use of the templates and is not responsible for any business, financial, or legal consequences arising from their use.

9. Governing Law

a. These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Pinkpops operates, without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be resolved in the appropriate courts of said jurisdiction.

By purchasing and using the Product, Buyer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
